About This Policy and Operator

Frequency is a community-centered mobile application designed to help members connect, share experiences, and engage with content related to wellness, consciousness, and personal elevation.

Path & Pace LLC, a limited liability company organized under the laws of the State of Georgia, United States, operates the Frequency App on behalf of the Frequency community. References in this Policy to "we," "us," "our," or the "Operator" refer to Path & Pace LLC acting in its capacity as operator of the App.

Information We Collect

We collect only the information necessary to operate the App and provide its features. The categories of information collected include:

• Contact Information: Your name, email address, and phone number, provided when you create an account or contact us.
• Profile Information: Any optional information you choose to add to your profile, such as a display name, bio, or interests.
• Usage and Interaction Data: Information about how you use the App, including features accessed, content viewed, time spent in the App, and interactions with other users or community features.
• Device and Technical Information: Device type, operating system version, unique device identifiers, IP address, language preferences, and crash logs.
• User-Submitted Content: Messages, posts, comments, or other content you voluntarily submit through community features, chat functions, or feedback channels.

The App is currently free to use and does not process payment information or financial transactions. If we introduce paid features in the future, this Policy will be updated to reflect any additional data practices.

How We Use Your Information

We use collected information for the following limited purposes:

• App Functionality: Creating and managing user accounts, authenticating identity, enabling community features, facilitating event reservations, and supporting core App operations.
• Product Personalization: Customizing your experience based on your activity, preferences, and interactions within the App.
• Analytics and Improvement: Analyzing usage patterns to improve features, identify and fix bugs, and develop new functionality.
• Communications: Sending account-related notices, security alerts, policy updates, and—where you have opted in—information about events, community activities, or new features.
• Safety, Security, and Integrity: Detecting, investigating, and preventing fraud, abuse, harassment, or violations of our Terms of Use or applicable law.
• Legal Compliance: Complying with applicable laws, regulations, court orders, subpoenas, or other legal processes; responding to lawful requests from public authorities.
• Protection of Rights: Enforcing our agreements, protecting the rights, property, or safety of the Operator, the Frequency community, App users, or others.

How We Share Your Information

We do not sell your personal information. We do not rent, trade, or share your personal information with third parties for their own marketing purposes. We share information only in the limited circumstances described below:

• Service Providers: We share information with trusted third-party vendors who provide infrastructure, hosting, analytics, communications, or technical services on our behalf. These vendors are contractually obligated to handle your information securely, use it solely as directed by us, and provide the same or equal protection of user data as required by Apple's App Store Review Guidelines and this Policy.
• Community Features: Information you voluntarily share within the App's community features—including your display name, profile information, posts, and messages in public or group channels—will be visible to other members of the Frequency community. You are responsible for what you share in these spaces.
• Legal Process and Safety: We may disclose information when we believe in good faith that disclosure is required by law, court order, subpoena, regulation, or governmental request, or where disclosure is necessary to investigate or prevent fraud, security threats, harm to persons or property, or violations of our Terms of Use.
• Business Transfers: In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will provide notice of any such transfer through the App or by email.
• With Your Consent: In any other case, we will share your information only with your explicit consent.

Data Retention

We retain your personal information for as long as your account remains active or as needed to provide the App's services to you. If you request account deletion, we will delete or anonymize your personal information within thirty (30) days, except where we are required or permitted to retain it for legal, regulatory, tax, accounting, security, fraud-prevention, or legitimate business purposes.

Aggregated or anonymized data that cannot reasonably be used to identify you may be retained indefinitely for analytics and product improvement purposes.

Your Rights and Choices

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including:

• Access: The right to request a copy of the personal information we hold about you.
• Correction: The right to request correction of inaccurate or incomplete information.
• Deletion: The right to request deletion of your personal information, subject to legal exceptions.
• Opt-Out: The right to opt out of non-essential communications at any time through your in-app settings or by contacting us.
• Data Portability: The right to receive a copy of your data in a commonly used, machine-readable format.
• Withdraw Consent: Where processing is based on your consent, the right to withdraw that consent at any time.

You also have the right to lodge a complaint with a data protection authority in your jurisdiction if you believe we have violated applicable privacy laws.

Children's Privacy

The Frequency App is not directed to, and is not intended for use by, children under the age of thirteen (13). We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act ("COPPA"). If we become aware that we have inadvertently collected personal information from a child under 13, we will take prompt steps to delete that information from our systems.

If you believe a child under 13 has provided us with personal information, please contact us immediately at jeremiahglover@hotmail.com so we can investigate and take appropriate action.

Users between the ages of 13 and 18 should review this Policy with a parent or legal guardian and obtain their consent before using the App.

Data Security

We implement reasonable and appropriate technical, administrative, and organizational measures designed to protect your personal information against unauthorized access, alteration, disclosure, loss, or destruction. These measures include encrypted data transmission, secure cloud storage infrastructure, access controls limited to authorized personnel, and regular review of security practices.

However, no method of electronic transmission, storage, or processing is one hundred percent secure. While we strive to use commercially reasonable means to protect your information, we cannot and do not guarantee absolute security. You acknowledge and accept that you provide your information at your own risk and that we are not liable for unauthorized access to or disclosure of information that is beyond our reasonable control.

Third-Party Services

The App integrates with or relies on certain third-party services, which may include cloud hosting and database providers, analytics services, push notification services, and authentication providers. These third parties may receive information about you in connection with their services and are bound by their own privacy policies, which we do not control.

We encourage you to review the privacy policies of any third-party services referenced in the App. Path & Pace LLC is not responsible for the privacy practices, content, or actions of third-party services, even when accessed through the App.

Tracking and Analytics Disclosure

Consistent with our Apple App Store privacy disclosures ("Privacy Nutrition Label"), the App may collect and use the following data types for the purposes listed:

• Name — Used for Product Personalization, Analytics, and App Functionality. Linked to user identity. May be used for tracking purposes.
• Email Address — Used for App Functionality, Analytics, and Product Personalization. Linked to user identity.
• Phone Number — Used for Analytics, App Functionality, and Product Personalization. Linked to user identity.

You may limit cross-app and cross-website tracking at any time by adjusting your device's privacy settings under Settings > Privacy & Security > Tracking on iOS. We will respect your tracking preferences as required by Apple's App Tracking Transparency framework.

International Users

The App is operated from the United States. If you access or use the App from outside the United States, you acknowledge that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence. By using the App, you consent to such transfer and processing.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other business factors. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice through the App, by email, or by other reasonable means.

Your continued use of the App following any update constitutes your acceptance of the revised Policy. If you do not agree to a revised Policy, you must discontinue use of the App.

Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PATH & PACE LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PATH & PACE LLC, ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS POLICY OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless Path & Pace LLC, its officers, members, managers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the App, (b) your violation of this Policy or applicable law, (c) your violation of any rights of another person or entity, or (d) any content you submit through the App.

Governing Law and Dispute Resolution

This Privacy Policy is governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising out of or related to this Policy or your use of the App shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction and venue of such courts.

You waive any right to a jury trial and agree that any claim must be brought in your individual capacity, not as part of a class action, collective action, or representative proceeding, to the fullest extent permitted by applicable law.

Severability

If any provision of this Privacy Policy is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

This Privacy Policy, together with our Terms of Use and any other legal notices published by us through the App, constitutes the entire agreement between you and Path & Pace LLC regarding the collection, use, and protection of your personal information in connection with the App.
